User submission about judicial relationships in the courtroom

Every time we get dragged into court by my wifes ex-husband, no matter what, the Judge sides in favor of HIM. The ex-huband’s Lawyer used to be partners with the Judge and the ex-husband’s sister works for the Judge also. We don’t really mind going to court, if we can just get a fair break.
Is this a conflict of interest?

Sounds like a conflict of interest to me, but unfortunately thats how many systems work in the court. Johnny, which court and judge is this you are talking about?

If you can prove this relationship has existed then you can ask for his recusal in these matters and if that doesnt work you can ask the superior court or appellate court for that jurisdiction for a writ of prohibition. You can find several formats on line that will help with this process. Good luck and take caution because if it fails you will have a ticked off Judge. But I guess in your matter it doesnt matter cause you arent getting a fair disposition anyway.

It happened to me. The judge rule in my ex’s favor always. Not sure if my ex’s attorney is a friend of the judge or not. Currently I am trying to rescind the judge. But all people told me it is impossible. But I have no choice but to do it, because she is not fair to me anyway. What else is she going to do to me? Send me to jail if I ask her to rescind?
