Judge Richard J. Arcara is ruling the case (Case No. 1:08-cv-0230) pending before US District Court, western New York. He unreasonably ordered Pro-se plaintiff to reserve the summons to save the defendant from the default although the service was proper and sufficient under Rule 4(d). Defendant committed over 14 months laches under Judge Arcara’s favoritism. The defendant again failed to answer within time, so the Clerk’s Entry of Default was entered. However, Judge Arcara issued a Scheduling Order and forced a Pretrial Conference despite the case’s statue is in default. Judge Arcara’s outrageous ruling beyond the rules and law must be stopped. Now a complaint against Judge Arcara is pending before Court of Appeal and a petition is pending before Congress and US Senate. Judge’s prejudice, favoritism based on possible corruption and bribery must not be allowed in the US Court.

My husband is currently in trial in Ventura county for a case in which he is actually innocent. But the judge wont even give him his legal right to cross examine the police officer. Also after every single objection our lawyer did, the judge wouldn’t allow it, even when the witness (accuser) changed his story, that objection was over ruled. What do I do? My husband is going to go to prison for a case he did not commit, and now the judge is being unfair. I even found out that the detective from the case was my ex-fiance’s brother whom use to beat me. (the ex, not the cop). And the detective is probably doing this just for revenge. But again the judge wont allow us to cross examine him. He didn’t even show up. Please HELP! Judge Anna Estevez is an unfair judge for sentencing my 18 year old son 10 years in prison for sexual contact with a minor. My son met this girl that said she was 18, as she had it posted on the internet as well, and 3 days later she cried rape, after he learned her age, he wanted nothing to do with her, and that’s when she cried rape. Without any evidence against him, this judge decided to make an example out of him.

Judge Brigitte Sivret sentenced Margaret Grant, A Moncton, NB woman to four years in jail for failing to provide adequate care for her sick Mother, Kathleen Grant which resulted in her death.

This is indeed a terrible tragedy but it is also a tragedy that our justice system would send a mentally ill woman/child of low intellect who lived a poverty stricken life to prison to serve as a warning to others.

The fact that Margaret Grant had three kids taken from her and one that chewed his first solid food in kindergarten speaks for itself, Why would The Department Of Social Development allow a woman they took THREE kids from to be a caretaker to her Mother? Doesn’t make sense… The system failed not just one but both of these women.

It will cost $166,830 a year to keep Margaret Gallant behind bars and possibly much more as I am sure she will require therapy as this woman IS mentally ill. Incarcerating a mentally ill woman with the intellect of a six year old child is not the answer. Therapy and making an effort to improve her quality of life outside of prison is.

I find it disgusting that this judge made an example of someone who is clearly mentally ill and of low intellect and has lived her entire 48 years in poverty. Yes, The system failed both Margaret and Kathleen Grant. The system required a scapegoat to shoulder the blame for the system that botched up so horribly and Margaret Grant was that scapegoat.

I would like to start by telling you thanks for taking the time and listening to the problems we have been having with the courts of Chicago.  Please let us come talk to someone there. This is only part of what has been happening to us. Sorry to take up your time.  Try to make it brief.

This has been going on for years. Arnold and Arthur Lynch were brothers who happened to live by my husband James Brya.  James always watched over them because of their money problems they would get into, not enough.  They couldn’t pay their bills or make house payments.  Arnold drank at the time not Arthur.  This period of time is about 12 years started around 1997.  Arnold & Arthur always told James that they would pay him back when they could.  James kept boxes of receipts & notes for the things he had paid for.  Arthur can not read or write and has a problem with monies.

Arnold had a bad car accident and was in the hospital for sometime.  In comes the police officer Mr. Richard Tracy. Who knew Arnold & Arthur from their past. Arthur went out and got an attorney for Arnold and the law suite stated for 1.5 million.  Tracy wanted Arnold to have a guardian thinking he would choose him, only Arnold chose James. This is where the problems start.  Tracy never makes it easy from here on it’s like a vendetta on the two plus James.  The attorney is Paul Anakin.  Tracy tells Arnold & Arthur he will get even.

Case starts James is appointed guardian May 8, 2002 to Arnold at $700.00 per month.  In the beginning no problems except for money, bills for Arthur & Arnold are too high with the house.  James is still helping and keeping receipts. James receives no monies for being guardian, but he is still paying their bills around $40.00 to 4500.00 a month Arnold & Arthur are still promising to pay him back some day.  James understands and believes that someday they will pay him back.  In 2005 the two men decide the house is too much and decide to sell.  But the house is in bad shape. They ask James if they find a person to fix it could he help with the payments until it is sold and they will pay him back.  James thinks about it and says yes.  They found a long time friend who gave them a good price.  The total rehab was around $34000.00 dollars paid in installments of three.  House sells and the men make about $77000.00 profit.  They pay James for the rehab.  Plus put the $44000.000 in the bank.  Arnold wants to pay James for the guardianship the he never received from court, Arnold only thinks it right.  Receipts for everything James has done in the years are still in boxes. James leaves money in bank and takes it when needed.  James still helps the two men.  So monies are still being used to help both men with expenses.  And they now live in James house because they have no house, one man upstairs and one man downstairs.

The lawsuit for Arnold is coming to and end.   The lawyer Paul Ankin has come to a conclusion that the man has no monies except for insurance of $25000.00 take it or leave it that is all there is.  Arnold signs paper and gets $11000.00 dollars and puts it in LaSalle bank March 2006 and Paul takes $14000.00.  Arnold dies April 13, 2006 James uses the money to bury Arnold which is around $6000.00.  Arthur the brother calls lawyer Paul and tells his secretary that Arnold is dead.  James never calls thinking that it’s OK because Arthur called and waits for Paul to call back with instructions.  James takes the balance of $5000.00 and uses it to help Arthur with his expenses. Paul never calls.

Arthur is still living in James place. Now he wants to try a place down the street.  Arthur has no furniture he wants to purchase James, James agrees. James helps him move, this is second time.  Arthur stays about one year and wants to move again.  He asks James if hr can move in our basement apartment we talk and agree, another move, three moves.  Arthur has always been with us still helped him if he needed it.  Took him to doctors & hospitals because he can’t drive gave him extra monies if needed.

Now Paul calls in 2007 and finds out Arnold has died.  Problems start.  Because James was guardian he was told that he didn’t follow the right rules for guardianship.  What rules James says no one told me about rules I was to take care of Arnold and I did.  You had me sign papers and I did, you said sign here and I did.  His brother Arthur called and you Paul never called back.  Paul puts in court to close Arnold’s case because of death.

Judge Kawamoto now receives letter from Richard Tracy and long and short of it, the case has been going on ever since.  What Richard claims in the letter we do not know, the court would not tell us or show us the letter.  But from the beginning Richard Tracy told Arthur that he would get him and that he would end up with nothing and in a home.

Back and forth with lawyer and guardianship our monies is gone.  We understand that James did not follow the rules to guardianship and so does he. He will take whatever the court has to give. But never once did he ever abandoned those two men Arnold & Arthur.  James never received any paperwork telling how to be a guardian he only followed his heart.

Arthur lived with us up until yesterday April 10, 2009.  Like I said before Arthur does have some problems but we love him very much and he has been treated bad by the courts of Chicago.  They are using him to get to James and that is not right.  James has not been convicted of any wrong doing up to now.  Arthur has never been in trouble with the law.  So far in this Arthur has been mistreated by the court system.  He would just like to have his voice in court and they won’t listen to him.  One psychiatrist said he was totally retarded and needed round clock care; please you need to meet this man and see for yourself.  We have paid for lawyers who did nothing to help Arthur. Arthur is 64 years old and lived all his life with no problem.  Why now?  He purchased two homes by himself, how did he do that.  I understand that he has problems and does not know common things like everyone else, but why do you call this mentally retarded.  In court this week they made him go to a home that he does not want to go to.  With a man that is 94 years old and dieing.  Arthur asked to stay with us and they told him we would hurt him.  Arthur has taken care himself
for 64 years.  Where was everybody for 64 years you tell me!  And if Richard Tracy knew this for so long why didn’t he help him.  Where was Tracy when the two men Arnold & Arthur needed help with their expenses & home?  Tracy made fun of the two and said they would lose everything.  James said no and stepped in to help.  It seems to me Tracy didn’t care, and wasn’t he the person who should have cared he’s a retired police officer.

The court system agrees that James gets none of the monies the court owes him for guardianship.  And the monies he received from Arnold & Arthur has to be paid back also even for the repairs on the house.  The receipts that James had for all those years Arthur threw out because they got wet and soggy in the basement and he thought he was helping James.  So no receipts but we have Arthur and the contractor, still no good.

The main problem is Arthur he is not being heard.  Let this man have his voice in court. Before anything else give Arthur his pride & dignity back.  He is a US citizen where are his rights?  We understand that he has special problems. Judge Kawamoto will not listen to anyone who wants to help Arthur or his brother.  And James has not been found guilty for any wrong doings it’s been 1-1/2 years.  The court is putting the cart before the horse.

PLEASE HELP US NO ONE WILL.

Judge Anna Estavez, Randall Co Amarillo Texas, refused to hear evidence of abuse to my grand-daughter, refused to listen to any of the facts in this case, even though two Montana Judges ruled to give stay of protection to their mother, and a Texas Judge Anderson same county in Texas heard all evidence and upheld the two judge’s decisions. Then, just 3 months later, Estavez is elected to the bench for the first time, being only a sub-standard real estate lawyer, but whose daddy is a wealthy, local, heart doctor, who worked for many years with the man accused, father and to top it off his mother works as a surgical nurse and worked with judge Estevez father at the same hospital for about 30 years! Now, to top that off, the judge the grandma, the accused man, and the therapist all go to the Catholic church together and the judge refuses to recluse herself and turns the children over to the accused man and his mother (he is 39 years old and still living with mommie!). She is the one who wants the children and tells them she is their mother, and not my daughter.

Their is so much proof of the injustices of this judge. What can be done? What have we done to ourselves by allowing our justice system to become so corrupt? How do we stop the insanity, and make these judges have consequences for their bias, and penalties for making decisions before hearing the evidence from both sides.

Please help, as my 6 and 7 year old grandchildren are in great danger!

I am a law student with a real property case in Santa Cruz, which involves nine easements in dispute. One party I am suing is Santa Cruz Title. SCT filed a demurrer in which they claim as escrow holder, they had no duty and that they were not named in the lawsuit. However, they were listed in my complaint properly and according to the law they do have a duty as escrow holder. However, Judge Samuel Stevens ruled in favor of their demurrer and I appealed a writ. However, my writ was AMAZINGLY denied without any explanation. What are my options now? ..will the California Supreme Court deny to hear such a case?Another amazing ruling is that even though I considered settling with my past realtor Alan Melikian and Bailey Property for a small amount of money, no settlement was reduced to writing. In fact, their attorney Hamerslough never even exchanged documents with me. However, Judge Stevens ruled in favor of attorney Hamerslough’s settlement motion without hearing any of the terms of the settlement and without any written agreement. I have not accepted any money for settlement, and won’t. I appealed this decision and it was denied without an explanation.

Is the court really that discriminatory that Judge Stevens can just make AMAZING rulings with no requirement to follow the law, and have the appeallate court uphold those rulings?

In 2007, before Judge Stevens was assigned, because Attorney Bosso did not like one set of interrogatories, Judge Burdick STOPPED all discovery making my case delayed for almost one year. What this enabled Bosso to do was unethically withhold the fact that his clients the Bowden’s were unlawfully using another non-deeded easement on my land (which they knew).  If the settlement had gone through, I would had unknowingly given up my rights regarding that additional easement; which would had been discovered through discovery.  Subsequently, Judge Burdick excused himself from the case.

During the judicial settlement conference, Judge Burdick did not discuss the merits of my case; but only told me ‘you are pro per,’ ‘pro pers never win.’

Recently, a head hunter called me and told me that before Judge Stevens was a judge, and was an attorney in Santa Cruz in the 80s, he was this man’s attorney. This man told me that Judge Stevens told this man that the Santa Cruz courts are such a good old boy system that he would be better off if he could get his case out of Santa Cruz County.  Does this corrupt system still exist?

Every time we get dragged into court by my wifes ex-husband, no matter what, the Judge sides in favor of HIM. The ex-huband’s Lawyer used to be partners with the Judge and the ex-husband’s sister works for the Judge also. We don’t really mind going to court, if we can just get a fair break.
Is this a conflict of interest?

I have a question I need answered: The local judge here in Brunswick county, North Carolina, has made threats to imprison people for 60 days and fine them $500 for wearing shorts in the court room. Can she do that? This judge also makes people swear on a bible before saying anything and refusal to do so can be punished by 120 days in jail. I mean hello.. division of church and state ring any bells? Plus they charge us $120 in court costs for 5 minutes of her time while six over weight hillbillies with guns (cops) tell me I go to jail if I don’t pay… This is armed robbery! There’s no other term for it. please let me know if she can get away with this Nazi regime shes running and if so how do I change it?

On April 10, 2008, I witnessed a terrible bias against a plaintiff in a termination of parental rights/adoption case in Judge Robert (Bob) Jones’ court in Maury County TN Chancery Court. The grandparents have had a child in their custody for almost three years. They are truly trying to save this child’s life. They rescued this child from an abusive and neglectful parent, who has never paid a penny towards the child’s care, and have spent almost $9,000 of their retirement money on litigation. They have spent even more on medical, psychological, and educational teatment for this child. Judge Jones showed immediate bias to the plaintiff just prior to the hearing in the hallway outside his office. Although he could have gone around her, he stared her down and ordered her to move out of his way. The plaintiff had never seen the judge before in her life. Despite over 600 pages of documents and seven witnesses consisting of 3-therapists, 3- teachers, and the defendants own brother, Judge Jones admonished the plaintiff for “hiring the law firm with the largest advertisement in the book and you are back to square one.” He refused to reset the case for trial and declared the defendant indigent although she has a job and just purchased a $21K car from an infinity dealer. Although the plaintiff’s attorney erred in his quest to locate one of the parents, Judge Jones failed in that he failed to appoint a guardian ad litem in this case, which had been on the calendar for several months. He was also way out of line to show bias towards the plaintiffs’ attorney. Judge Jones job was to give these plaintiffs (and the defendant) the right to have their evidence heard and to make a fair judgment based on that evidence. He has no right to decide, before listening to one shred of evidence, that the case has no merit and that the abusive mother should be allowed to seek remedy through juvenile court. He certainly has no right to criticize a litigant for their choice of attorney and penalize them for this.
